TERMS AND CONDITIONS.

1.These terms and conditions together with any specific rules set out in Competition Notices as defined below are the Competition Rules ("Rules"). By entering the Competition, entrants agree to be bound by these Rules.

2.In the event of any dispute regarding the Rules, Competition Notice, conduct, results and all other matters relating to the Competition, the decision of Austrek Tours Pty Ltd shall be final and no correspondence or discussion shall be entered into.

v     One (1) winner will be drawn on the first day of July 2010 from a pool of birth dates for the, and thereafter again on first of each month until the last draw which will be on the first day of June 2011. In the event that the 1st is a Saturday, a Sunday or a Public Holiday, then the draw will take place on the first business day of the stipulated month(s).  Prizes will be drawn on alternate months: eg girls with CityClubbhoper one month and boys with Pubtrek HappyDayz with Karts.  Therefore six of each type of trip will be drawn over the twelve month period.

 

v     The winner must be at least 18 years of age at the time the prize is taken.

v     The winner will be announced on the Austrek Tours Website newsletter at www.partyonthebus.com.au 2-7 days after draw.

v     The prize will be a Pubtrek HappyDayz with Karts Trip or CityClubbhopper for 20 (maximum) people. (Hereafter also called _The Trip _). The Prize winner may invite more than 20 persons, however everyone over the 20th person must pay $115 per person for HappyDayz or $88 per person for CityClubhopper.

v     The prize must be claimed within seven (7) days of the draw, or a second chance re-draw will occur. In this event, the redraw will occur on the eighth day of the month from a pool of birth dates for the prize.

v     In the event that the second chance re-draw is also not claimed, the prize for that month will be forfeited.

v     The winner, having claimed their prize within the specified time period, must take the Trip within the month of their actual birth date (subject to the date picked being avail), or at a mutually agreed date if the picked date is not available.

v     The prize may be taken on any weeknight, excluding Saturday and Sunday, for Cityclubhopper or Sunday only for Pubtrek HappyDayz with Karts.

v     The winner, upon claiming the prize, must provide suitable ID to prove their identity and birth date.

v     By claiming the prize and subsequently taking the Trip, the winner agrees that we may use their name and suburb, and any photographs taken of the winner or anyone included on the Trip, for promotional purposes only.

v     The winner agrees to pay a $300 bond, either in cash or by credit card, prior to the Trip taking place. This amount will be refunded in full if there is no damage caused to our bus or the Business throughout the Trip.

v     By claiming the prize and subsequently taking the Trip, the winner agrees that we may charge a Damages fee for any wilful damage caused to the bus or any Business associates of Austrek Tours or its agents, or the General Public.

v     All invitees of the winner must be at least 18 years or older at the time of the Trip. Suitable age ID may be required and is the responsibility of each individual. Any person unable to satisfy this condition may be excluded from the Trip. Austrek Tours Pty Ltd or its employees or agents will accept no responsibility for this consequence.

v     All invitees as well as the Prizewinner agree that by participating in the Trip, a Waiver sheet stating their name, contact phone number, email address and date of birth must be completed before commencement of the trip.

v     All invitees as well as the Prize Winner agree that no glass bottles or glass of any description is to be brought on board the bus, and that if in breach of this condition, the Trip may be terminated with no subsequent compensation being offered.

 

INCLUSIONS (City Clubhopper and Pubtrek HappyDayz with Karts Trips ONLY)

 

ü   Party Bus with sound system and microphone, Driver and Tour Guide/Social Photographer.

ü   Bins and drink tubs.

ü   Pick up and drop off must be from one location, within one hour bus drive from Leppington, NSW.

ü   HappyDayz with Karts includes 2 x Track Passes per person and a Hot Dog and Slurpie.

ü   Tour to three (3) pubs or clubs.

ü   Door entries.

ü   Austrek Tours _Party Organiser _ to help arrange and invite the list of guests.

 

EXCLUSIONS (City Clubhopper and Pubtrek HappyDayz with Karts Trips ONLY)

 

Ø     Prize does not include the provision or supply of alcohol. Any alcohol or other beverages are at the individual expense of the participants. Limit of 2 cans per person.

Ø     No ice will be supplied.

 

 

3. Qualifying Entrants

3a. Everyone who makes an enquiry regarding our services, and subsequently gives us their date of birth, will automatically be entered into the Competition. Employees or family members of Austrek Tours Pty Ltd will not be eligible to enter or win, nor employees or any Company or persons involved directly or indirectly with Austrek Tours Pty Ltd.

3b. By entering the Competition, you hereby warrant that all information submitted by you is true, current and complete.

3c. Austrek Tours Pty Ltd assumes that by entering you in the Competition (and you warrant that) either you have legal capacity to enter the Competition and agree to the Rules (i.e. that you are of sufficient age and mental capacity and are entitled to be legally bound in contract). Persons under the age of 18 years of age will be ineligible to enter the competition, the prize will be forfeited and Austrek Tours Pty Ltd will reserve the right to re-draw or cancel that month _s prize as it sees fit

3d. Austrek Tours Pty Ltd in its sole discretion reserves the right to disqualify any entrant if it has reasonable grounds to believe that the entrant has breached any of these terms and conditions.

3e. In the event that any entrant is disqualified from the Competition, Austrek Tours Pty Ltd in its sole discretion may decide whether a replacement contestant should be selected. In this event, the disqualified person will not be eligible to enter the Competition re-draw.

4. Liability

4a. Austrek Tours Pty Ltd cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to entries, or entries lost or delayed whether or not arising during operation or transmission.

5. Prizes

5a. The first person to be drawn each month of the promotion will be the winner, subject to the conditions of (3), (3a), (3b), (3c), (3d) and (3e).

5b. In all matters the decision of the judge(s) and Austrek Tours Pty Ltd shall be final and no correspondence or discussion shall be entered into.

5c. The winner will be announced on the Austrek Tours Pty Ltd Website newsletter at www.partyonthebus.com.au and will have seven (7) days to make the claim for the prize.

 

6. Liability

Austrek Tours cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the competition or as a result of accepting any prize, or any prize forfeiture. Nothing shall exclude Austrek Tours Pty Ltd liability for death or personal injury as a result of its negligence.

7. Data Protection and Publicity

7a. Winners may be requested to take part in promotional activity and Austrek Tours Pty Ltd reserves the right to use the names of winners, their photographs and audio and/or visual recordings of them in any publicity.

7b. Any personal data relating to entrants will not be disclosed to a third party without the individual's prior consent.

v     Prize Draw will be by computer generation on the first day of July 2010, August 2010, September 2010, October 2010, November 2010, December 2010. January 2011, February 2011, March 2011, April 2011, May 2011, June 2011 at 76 Alma Rd Leppington NSW 2179. (In the event that the 1st is a Saturday, a Sunday or a Public Holiday, then the draw will take place on the first business day of the stipulated month(s).)
